Terms of Service
Introduction
Welcome to TamaCares, the virtual services platform of Transatlantic Medical Associates (TAMA) LLC ("TamaCares," "we," "us," or "our"). TamaCares is a Virginia‐based limited liability company established in June 2023 and registered under U.S. law, license number 0101254201, and company number 11552841. Our principal in‐person clinic is located at 5724 Edsall Rd, Suite B, Alexandria, VA 22304. TAMA maintains a National Provider Identifier (NPI) of 1851119721.
By using TamaCares (the "Services"), you ("User" or "you") agree to be bound by these Terms of Service (the "Terms"). Please read these Terms carefully. If you do not agree, you must immediately discontinue use of our Services.
Scope of Services
Virtual Prescription Conversion
TamaCares specializes in reviewing and "co‐signing" foreign prescriptions to align with U.S. standards for potential dispensing in the United States. Our U.S.‐licensed physicians verify that these prescriptions meet FDA requirements. A co‐signed prescription may still be subject to the acceptance policies of individual U.S. pharmacies.
In‐Person Healthcare
TamaCares is part of Transatlantic Medical Associates (TAMA) LLC, which also offers in‐person medical consultations at our clinic in Alexandria, Virginia. These consultations may include evaluations, diagnoses, or treatments by U.S.‐licensed physicians. In‐person consultations are not covered by these Terms in their entirety and may be subject to additional patient consent forms, disclosures, or state regulations.
Medical Devices
We also advise on selecting non‐restricted personal‐use medical devices. This advisory role is provided solely for your convenience and does not constitute an endorsement or guarantee of device performance.
User Eligibility and Responsibilities
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to utilize our Services. If you are under 18, a parent or guardian must supervise your use.
You must be legally competent to enter into a binding agreement.
Accuracy of Information
You agree to provide accurate, complete, and up‐to‐date information regarding your identity, contact details, medical history, and prescription records.
You must not provide false, fraudulent, or misleading information. Violations may result in immediate termination of Services and potential legal action.
Compliance With Laws
You agree to comply with all applicable U.S. federal, state, and local laws, including but not limited to FDA regulations and state boards of pharmacy requirements.
If you are outside the U.S., you remain responsible for ensuring you do not violate the laws of your home jurisdiction.
Insurance Coverage (Foreign Prescription Conversion)
For our foreign prescription conversion service, you affirm that:
- The prescription was issued by a licensed healthcare professional in the country of origin and is not intended for use through any U.S. insurance plan.
- You or the patient does not have prescription insurance coverage from any U.S. insurer for the medication in question.
HIPAA and Privacy Practices
As a healthcare services provider, we strive to comply with the Health Insurance Portability and Accountability Act (HIPAA) and its regulations for the handling of Protected Health Information (PHI).
Our use and disclosure of your personal data, including health information, is governed by our Privacy Policy and, where applicable, our HIPAA Notice of Privacy Practices. We employ reasonable security measures but cannot guarantee against all data breaches or cyber attacks.
We may utilize third‐party services or telehealth platforms. We are not liable for breaches or failures caused by those third parties, provided we have made reasonable efforts to ensure their compliance with privacy standards.
Prescription Co‐Signing Agreement
Even if our U.S.‐licensed physician co‐signs a foreign prescription, individual pharmacies reserve the right to refuse fulfillment based on their internal policies. Co‐signing is primarily an administrative verification. It is not a diagnosis, nor a promise of therapeutic efficacy, nor a replacement for comprehensive medical consultation. TamaCares may contact the user, the prescribing healthcare professional, or the patient to verify any prescription details. We reserve the right to refuse or revoke co‐signing services for suspected fraud, incomplete information, or non‐compliance with U.S. requirements.
In‐Person Clinical Services
TAMA's in‐person clinic provides medical consultations for conditions like tropical diseases, general evaluations, diagnoses, and treatments performed by U.S.‐licensed doctors on‐site.
Additional intake forms, consent documents, and insurance verifications (if applicable) may be required for in‐person visits. These Terms supplement but do not fully replace any other patient agreement you may sign at our physical clinic.
Disclaimers
No Medical Warranty
Medical treatments and medications carry inherent risks. TamaCares makes no guarantees regarding the efficacy or outcomes of any medication, treatment, or medical device. Our co‐signing of prescriptions is not an endorsement of the medication's fitness for any particular purpose.
Not Insurance
We are not an insurance carrier. We do not guarantee coverage or reimbursement for your prescriptions, medications, or medical devices.
Limitation of Liability
To the maximum extent permitted by law:
TamaCares shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or goodwill.
In no event shall TamaCares' total liability exceed the amounts you paid directly to TamaCares for the specific service at issue, or one hundred U.S. dollars (USD $100), whichever is greater.
Indemnification
You agree to indemnify and hold harmless Transatlantic Medical Associates (TAMA) LLC (d/b/a TamaCares), its officers, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms or violation of applicable law
- False, inaccurate, or misleading information you provide
- Any misuse of our Services
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the state or federal courts located in Alexandria, Virginia.
Modifications to the Services
We reserve the right to modify, suspend, or discontinue any portion of our Services at any time, with or without notice, for any reason. We also reserve the right to refuse service to anyone for lawful reasons, including suspected abuse, fraud, or violation of these Terms.
Changes to These Terms
We may update these Terms at our discretion. If we make material changes, we will provide notice (e.g., by posting a notice on our website or via email). The updated Terms will be effective once posted. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
Intellectual Property
Ownership: All logos, trademarks, and service marks displayed on TamaCares are owned by Transatlantic Medical Associates LLC or its licensors. You may not use them without prior written permission.
User Content: Where you provide us with information or feedback, you grant us a non‐exclusive, worldwide, royalty‐free license to use it for the purpose of providing and improving our Services, subject to our Privacy Policy and HIPAA obligations.
Force Majeure
We shall not be liable for delays, failures, or interruptions in providing Services resulting from acts beyond our reasonable control, including natural disasters, governmental actions, network interruptions, or other events commonly considered "force majeure."
Entire Agreement and Severability
These Terms and our Privacy Policy (including any HIPAA notices) constitute the entire agreement between you and TamaCares regarding your use of our Services, superseding any prior agreements or understandings. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
